These Terms of Service are an agreement between you and HudsonHost. By creating an account, ordering a service, using the AI Website Builder, or otherwise using HudsonHost, you agree to these terms and our Privacy Policy. If you use HudsonHost for an organization, you confirm that you have authority to accept these terms for that organization.
1. Services and accounts
HudsonHost may provide AI website-building tools, website hosting, KVM virtual private servers, domain registration and transfer services, DNS management, account management, billing, and support. Features may change as HudsonHost develops. You must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized access.
Freemium AI Builder use does not require an account. Guest websites are temporary and may expire after 24 hours, so you are responsible for downloading your work. Paid accounts currently require email verification. HudsonHost expects to offer a choice of text-message or email verification in the future.
2. Acceptable use and content restrictions
You may not use HudsonHost for anything illegal. You are responsible for researching and complying with the laws that apply to your content, business, visitors, and activities, including the laws of California, where HudsonHost servers are located. You may not use the services to facilitate fraud, malware, unauthorized access, phishing, exploitation, trafficking, intellectual-property infringement, threats, harassment, nonconsensual intimate content, child sexual abuse material, or attacks on other systems.
You must have the rights and permissions needed for all content you upload, generate, publish, or distribute. HudsonHost may suspend, restrict, preserve, or remove content or services when reasonably necessary to address abuse, security threats, legal process, payment issues, or violations of these terms.
3. AI Website Builder
AI output can contain mistakes, incomplete information, or material similar to existing content. You must review generated websites for accuracy, accessibility, security, legality, licenses, and suitability before publishing them. You retain rights you already hold in your prompts and uploaded materials. Subject to applicable law and third-party rights, you may use and download generated website output. Do not submit confidential information or personal information you lack permission to process.
4. Hosting, VPS, domains, and DNS
Resource limits, supported software, backups, availability, and management responsibilities depend on the selected service. You are responsible for maintaining your own current backups unless a service description expressly says otherwise. VPS customers are responsible for server administration, software updates, access controls, and content unless a managed service is expressly purchased.
Domain registrations and transfers depend on registry and registrar availability, policies, verification, and fees. A search result is not a guarantee that a domain can be registered. Basic privacy and DNS management are included where supported. Advanced privacy is optional at $5 per domain each year and blocks additional WHOIS details where registrar and registry rules permit. You remain responsible for accurate registrant information and timely renewal.
5. Billing and PayPal
Prices, billing periods, renewal terms, and taxes are shown during ordering. You authorize HudsonHost and its payment providers to process charges you approve. PayPal is an independent payment provider and may process transaction, identity, device, fraud-prevention, and payment information under its own agreements and privacy statement. PayPal availability and payment approval are controlled by PayPal.
Unless otherwise stated, fees already earned for delivered services are nonrefundable. Approved refunds are returned through the original payment method when practical. Chargebacks, failed payments, or overdue balances may delay provisioning or result in suspension. You remain responsible for valid charges and applicable taxes.
6. Email and text-message verification
HudsonHost currently uses email verification for new accounts. If text verification becomes available, you may choose text or email. Choosing text authorizes HudsonHost to send transactional verification codes, security alerts, account notices, billing notices, and service messages to the number you provide. Message frequency varies. Message and data rates may apply. Reply STOP to cancel recurring text messages and HELP for help. Carriers are not liable for delayed or undelivered messages.
Consent to text messages is not a condition of purchase when email verification is available. You must provide a mobile number you control. Consent applies only to HudsonHost messages for the stated purposes and is not shared with third parties for their own marketing. Opting out of texts may require you to use email for verification and account notices.
7. Availability and warranties
Services are provided on an as-available basis. HudsonHost works to provide reliable service but does not promise uninterrupted or error-free operation. To the fullest extent allowed by law, HudsonHost disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
8. Limitation of liability
To the fullest extent allowed by law, HudsonHost will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption. HudsonHost's aggregate liability for a claim will not exceed the amount you paid HudsonHost for the affected service during the three months before the event giving rise to the claim. Some jurisdictions do not allow every limitation, so these limits apply only to the extent permitted.
9. Changes and termination
You may stop using Freemium at any time and may request cancellation of paid services through the Account Manager or Help Center. We may update these terms as services and legal requirements change. Material changes will be posted with a new effective date and, when appropriate, communicated through the account contact method.
10. Governing law and contact
